General

This GOGIDA site at www.gogida.com.au is a on-line ecommerce platform where you can browse, select and order products advertised on the Site (“Products”) from EUGENEMAX PTY LTD (ABN 40 603 567 406).

Registration

Any personal information that you give us will be held and may be used or disclosed by us in accordance with our privacy policy.

You may not have more than one active account at any one time, and your account is non-transferable. You may update, edit or terminate your account at any time through the Site. There cannot be more than two accounts per billing address.

Please note that we will use the email address provided by you to notify you of relevant information from time to time, including (but not limited to) information about your orders, our latest offers or your favourite products, invitations to participate in events or provide feedback about our products.

USERNAME AND PASSWORD

You are responsible for the safekeeping of your user name and password. You are liable if your account is misused by an unauthorised person.

Ordering via GOGIDA’s Website or via the Phone

When placing an order with GOGIDA via the website or via phone with our Customer Service Team, you confirm that all the details that you have provided in completing the order and offer to purchase the liquor are true and correct. It is a condition of purchase that you verify that you are 18 years of age or over. If you do not confirm that you are 18 years or over, your order will not be processed.

LIQUOR LICENSE

Your contract of sale is with EUGENEMAX PTY LTD, Liquor License number LIQPxxxxxx as the liquor is sold from our website by our licensee on behalf of GOGIDA. Your offer to purchase is subject to acceptance of your offer by the holder of the Liquor License, certification and evidence of you being over 18 years of age.

Responsible Service of Alcohol

GOGIDA takes the responsible service of alcohol very seriously. If you, the customer, look under 25 and are unable to present valid photo identification, your order will be cancelled. If anyone present at the premises at the time of delivery looks under 25 and is not able to present valid photo identification, your order will be cancelled. If you, the customer, show signs of intoxication either when placing your order or at the time of delivery, your order will be cancelled. Alcohol cannot be left unattended for any reason at any time. We reserve the right to refuse service at our sole discretion; this may be because of our concern for a customer’s welfare and our commitment to responsible service in the community.

DELIVERY POLICY

GOGIDA will work with our carrier partners to deliver the Goods to you at the Delivery Address provided. We will make our best effort to deliver within the time agreed with you, however events beyond our reasonable control may occur from time to time which means that these delivery times may not be met. If this occurs, we will endeavour to contact you to arrange an alternative delivery time.

Delivery Fee: If required by GOGIDA, you must pay the Delivery Fee for each Order with GOGIDA. You acknowledge that the Delivery Fee may not be refundable. Due to strict licensing regulations we are unable to leave orders unattended on your doorstep or at any other address other than the customer information collected at the time of the order. We allow our driver to wait up to 10 minutes to give you every opportunity to receive your order. In the case the order is not successfully collected we will issue a non-refundable delivery fee and a $20.00 restocking fee. All customers must be able to present a valid form of photo identification to receive their order.

Delivery costs
Delivery is free for orders over $80 within 13km city radius.
We charge a flat rate of AUD $7.90 delivery fee for every order under $80.

ID verification; other safety checks

It is the responsibility of the Retailer and any delivery provider to verify identification and age, and to determine whether it is otherwise safe and appropriate to provide you with alcohol. They may require a valid form of photo identification with date of birth and a signed acknowledgment confirming acceptance at the time of pick-up or delivery. If they cannot verify your age or identity, if you appear intoxicated, or if the situation is otherwise unsafe or inappropriate (for example, you are 25 but appear to be in the company of only underage persons), they may refuse to provide you with alcohol.

Alcohol cannot be left unattended—someone 18 or older must be present to accept and sign for it. If a Retailer is unable to deliver your product for this or a similar reason, the Retailer may charge a restocking fee. Subsequent delivery attempts are at the discretion of the Retailer and are subject to redelivery fees.

If we believe that your order is fraudulent or unlawful, we may alert the Retailer and suspend your use of the Service.

CANCELLED ORDERS

If your order has been cancelled because you cannot present valid form of identification or you are intoxicated, your order will also be refunded, except for the delivery fee, which will be charged. If your order has been cancelled because you were unable to accept delivery because of an incorrect address or phone number your order will be refunded, except for the delivery fee, which will be charged.

RETURNS & REFUNDS

GOGIDA strictly does not offer any returns or refunds on purchases. You agree that you cannot change or cancel an order once payment has been confirmed. If you are unhappy with your purchase, please contact our customer service team immediately during business trading hours.

Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong decision. You can choose between a refund, exchange or credit where goods are faulty, have been wrongly described, are different to the product purchased on the website or doesn’t do what it is supposed to do.

Minimum order value

We reserve the right to set a minimum order value.

Fraud and risk assessment

We have processes in place to assist in detecting transactions that may be illegal or in breach of these terms and conditions. We may contact you by telephone or email to confirm your payment and information details. If we are unable to confirm these details, we may not accept or cancel your Order.
